Welcome to the Casa del Equine website (the “Site”).
Casa del Equine is owned and operated by Scott Prendergast. (ABN: 647 5027 00 54) and Nicole Kostov (ABN: 422 437 341 38) In this policy any reference to ‘us’ ‘we’ or ‘our’ refers to Casa del Equine and our agents, successors, assigns or subsidiaries.
Acceptance of Terms
Casa del Equine provides equine-related products and packages for horse riders and your horse or as a gift to other horse owners. Access to the Website, use of the Services, and purchase of the Products is subject to these Terms and Conditions.
Use of this site
You must not use the Site for any of the following purposes, which are expressly prohibited by Casa del Equine: (i) Engaging in any conduct that would violate any law or regulation in any applicable jurisdiction. (ii) Attempting to interfere in any way with the Site’s or Casa del Equine’s network security, or attempting to use the Site’s service to gain unauthorised access to any other computer system or network. (iii) You are responsible for maintaining the confidentiality of Your login details and You accept responsibility for all activities that occur under Your login. You must notify Casa del Equine immediately in the event of any unauthorised use or misuse of Your account or where there is any other breach of security. (iv) Casa del Equine reserves the right to revise these Terms at any time and for any reason without notice to You. It is Your responsibility to review these Terms each time You use the Site. (v) Casa del Equine reserves the right to, at any time and without notice to You, alter the products and services available on and through this Site and to change, suspend or discontinue any aspect of this Site without liability to You or to any third party.
You must be over 18 to register for and use this Site if you sign up to one of our monthly subscription packages. Casa del Equine reserves the right to, at any time at our sole discretion, revoke your membership for any reason, including but not limited to, for breach of these Terms.
As a user of Casa del Equine, you agree to receive emails promoting our products or packages. We may from time to time send you promotional emails. You may opt-out from receiving special promotions or our newsletter by emailing “Opt-out” to firstname.lastname@example.org
Products and Packages
One off equestrian packages may be purchased as advertised or we will happily work with you to create a bespoke equestrian package that's right for you. Our one off equestrian packages are paid for at the time of the purchase - these are not monthly subscription payments.
If you are a monthly subscription holder, each month, we will ship you your chosen package (“POSH PACKAGE” or “LUXURY LOVERS PACKAGE”) with a different selection of items for you and your horse that may consist of a selection from treats, hygiene products, grooming products, tack items, accessories, clothing or other equine-related items (“Products”). Each month of your subscription, the selection of Products may change.
Casa del Equine advises you take care when introducing new products to your horse(s), including seeking veterinary advice at your expense, where You may be unaware of the affects using certain products and/or ingredients may have on your horse(s). Casa del Equine do not endorse or support any medical claims made by any products contained within our packages and takes no responsibility or liability for their affects in both humans and/or horses(s).
While we source products from local (Australian) brands and International brands, we do not guarantee every month will include both local and International brands. There may be times where the package for a chosen month only contains Australian brand items.
We do guarantee the total recommended retail price (RRP) of each subscription package will exceed the monthly subscription cost charged to You. Meaning, if you were to purchase each individual product item contained in your package separately from multiple retailers at the recommended retail price (RRP), it would exceed your $59 AUD monthly subscription cost for your “POSH PACKAGE” or your $89 AUD monthly subscription cost for your “LUXURY LOVERS PACKAGE”.
Items in launch packages may differ from the items shown in promotional materials that advertise items in packages for a specific month. Casa del Equine does not guarantee that all products shown in promotional materials will look exactly the same as the products you receive in your package; they may vary by colour, size, or brand. Additionally, if we run out of a product during the packaging process, you may receive a different item in your package than what is shown in promotional materials.
Casa del Equine subscription packages automatically renew on the anniversary date of your initial purchase each month.
Example: If your initial purchase was made on December 8th 2020, you would not receive a package in December 2020 as it is after the cut off date of December 5th 2020 - you would receive, and be paying for the January 2021 package - your next monthly payment date would be January 8th 2021, being the anniversary of your initial payment.
Example: If your initial purchase was made on December 4th 2020, you would receive a package in December 2020 as it is before the cut off date of December 5th 2020 - your next monthly payment date would be January 4th 2021, being the anniversary of your initial payment.
Meaning, by subscribing, you agree to pay the regular monthly subscription fee of your chosen package (being $59 AUD per month for our “POSH PACKAGE” OR $89 AUD per month for our “LUXURY LOVERS PACKAGE”) in order to receive the products or package supplied by us each month. This will continue on an automatic basis until you notify us of cancellation via email to email@example.com. Refer to Cancellation Policy below for full details. If you sign up for a Casa del Equine subscription using a promotional code or discount voucher for a percentage off your first package, then all subsequent packages will automatically renew at the regular price (being $59 AUD per month for our “POSH PACKAGE” OR $89 AUD per month for our “LUXURY LOVERS PACKAGE”).
It is your responsibility to determine the suitability of a product or service for You, Casa del Equine expressly excludes all liability in relation to this. Casa del Equine reserves the right to, at its sole discretion, limit the quantity of products or packages purchased by any User through this site at any time and for any reason.
All one off equestrian packages and individual products purchased will be posted within 1-2 business days from the time of your purchase where products are in stock. You will be notified if stock is not available and we will offer you a refund or an estimated restock date of your item(s).
For monthly subscription holders, providing your subscription payment was made successfully for the month, by the cut off date of the 5th day of each month, any products or packages purchased by You from this Site will be posted on the 15th day of each month. Casa del Equine takes no responsibility once the products or packages have been posted and will not be liable for any damaged, delayed or missing products or packages posted.
Monthly subscriptions may be cancelled at any time. All subscription cancellation requests can be completed by emailing firstname.lastname@example.org ONLY.
No cancellation requests will be processed if received via phone, text, social media, or any other method.
Indemnification and Limitation of Liability
Your use of this Site, is at all times at Your own risk and you assume all responsibility. All information, content, products or packages available on or in any way through this Site are provided to You on an as is basis. From time to time this Site may contain links to other third party websites. Casa del Equine does not in any way endorse the content of any such websites or make any representations, warranties or guarantees in relation to those sites and We expressly exclude any liability which may arise from Your access to those third party websites.
All products are individually checked and packed for quality before posting and while we try our best to ensure that the product is delivered to You in immaculate condition, the product may be damaged in the delivery process. If You receive a product from us that has been damaged, you can email us at email@example.com for instructions on how to return the damaged product and We will re-send the product to you where it is still in stock. If we do not have the same item in stock, we will work with our suppliers to source a replacement product for you. If the damaged product has been discontinued by the supplier, we will send you a similar replacement product where possible. You pay for the cost to return the damaged product and We pay the additional postage cost to send You the replacement product.
We will not refund or replace any opened or used products.
